When This Privacy Policy Applies

This Privacy Policy explains how Meridian Performance Health LLC ("Meridian," "we," "us," or "our") collects, uses, discloses, and protects Personal Information in connection with our website, membership enrollment, nonclinical coaching services, customer support, billing administration, and related communications (collectively, the "Services").

Meridian is a nonclinical health, fitness, nutrition, performance, and wellness coaching and administrative coordination business. Meridian is not a medical practice and does not diagnose, prescribe, or provide medical treatment. Clinical care, laboratory services, genetic testing, pharmacy services, and other specialized services are provided through independent third parties that maintain their own portals, terms, privacy notices, consents, and professional responsibilities.

This Policy applies only to information Meridian controls. It does not govern information independently collected or controlled by a genetic-testing affiliate, medical-wellness technology or administrative platform, medical group, clinician, laboratory, pharmacy, payment processor, shipping provider, or other third party. The identity of an applicable third party will be disclosed within the relevant portal, order process, consent, or service documentation. Information maintained by that third party is governed by its own privacy notice and, where applicable, its notice of privacy practices.

Meridian provides Services in the United States to adults age 18 or older. By using the Services, you acknowledge that you have reviewed this Policy and our Website Terms and Conditions. A signed Membership Agreement and separate third-party terms may also apply to particular products or services.

Personal Information We Collect

The information Meridian collects depends on how you interact with us and which Services you request. It may include:

  • Information You Provide. Your name, email address, mailing address, communication preferences, questions, website-form entries, account information, and other information you choose to provide.
  • Membership and Transaction Information. Your selected membership, enrollment option, billing status, payment confirmations, purchase history, cancellation requests, signed agreements, acknowledgments, and customer-support records. Complete payment-card numbers are generally collected by the payment processor rather than stored by Meridian.
  • Coaching and Wellness Information. Goals, workout activity, general nutrition information, habits, progress, preferences, measurements, limitations, messages, photographs, scheduling information, and other information you voluntarily provide through Meridian or its white-labeled coaching environment.
  • Consumer Health Information You Choose to Disclose. General information concerning health goals, symptoms, conditions, medications, supplements, physical activity, nutrition, hormonal or reproductive wellness, and other health-related interests provided for nonclinical coaching or coordination.
  • Authorized Portal-View Information. Where authorized through an independent partner or affiliate portal, Meridian may view laboratory or genetic reports for the limited purpose of providing requested coaching or coordination. The reports remain controlled and stored by the originating platform.
  • Information From Third Parties. Contact, order, account-status, referral, fulfillment, and other information received from vendors, affiliates, payment processors, or service providers as necessary to provide a product or Service you requested.
  • Website and Device Information. IP address, browser type, device type, operating system, referring page, pages viewed, approximate location inferred from an IP address, cookie identifiers, and security, diagnostic, and interaction logs.
  • Communications. Emails, support requests, feedback, consent records, and other correspondence with Meridian.

Meridian does not intentionally collect precise geolocation through its general website, and it does not ask you to submit medical records, laboratory reports, raw DNA files, genetic reports, prescription records, Social Security numbers, or insurance records through general website forms, ordinary email, text message, or the coaching environment.

How We Use Personal Information

Meridian may use Personal Information for the following purposes:

  • To Provide the Services. Create and administer memberships, provide nonclinical coaching and education, coordinate requested products and services, arrange account invitations or authorized orders, and fulfill requests.
  • To Personalize Your Experience. Understand your stated goals, preferences, participation, and progress and tailor nonclinical coaching within the scope of your membership.
  • To Communicate With You. Respond to questions, provide support, send billing and account notices, deliver security or policy updates, schedule Services, and communicate about our relationship.
  • To Process Transactions. Administer enrollment charges, recurring billing, receipts, payment status, cancellations, disputes, and related accounting records.
  • To Operate and Improve the Services. Maintain functionality, troubleshoot problems, evaluate engagement, improve workflows and content, and develop new offerings.
  • To Protect Meridian and Others. Authenticate accounts, maintain security, prevent fraud or misuse, enforce agreements, investigate incidents, and protect rights, property, and safety.
  • For Marketing With Appropriate Choice. Send information about Meridian products, Services, educational content, surveys, and promotions where permitted. You may unsubscribe from promotional email without stopping necessary transactional or service messages.
  • To Comply With Law. Satisfy legal, regulatory, tax, accounting, insurance, and recordkeeping requirements and establish, exercise, or defend legal claims.
  • As Otherwise Disclosed to You. Use information for another purpose described when the information is collected or with your direction or consent.

Meridian does not use medical laboratory reports, raw genetic files, or genetic reports for targeted advertising. Meridian does not sell Personal Information, genetic information, or consumer health data for money or other valuable consideration.

How We Disclose Personal Information

Meridian may disclose the minimum information reasonably necessary in the following circumstances:

  • With Service Providers. Vendors that support coaching, communications, website hosting, security, electronic signatures, billing, payment processing, accounting, customer support, and other business operations may process information on Meridian's behalf.
  • With Affiliates and Coordinated-Service Platforms. Genetic-testing affiliates, medical-wellness technology or administrative platforms, and other coordinated-service providers may receive information necessary to create an account invitation, arrange an authorized order, provide support, or fulfill a Service you request.
  • With Independent Service Professionals and Fulfillment Organizations. Independent medical groups, licensed clinicians, laboratories, pharmacies, testing providers, fulfillment companies, and shipping carriers may receive information necessary to provide a product or service you request, generally through the platform responsible for that service.
  • At Your Direction or With Your Consent. Meridian may disclose information to a person or organization you identify or authorize.
  • For Legal and Safety Reasons. Meridian may disclose information when required or permitted by law, legal process, court order, or regulatory request, or when reasonably necessary to prevent fraud, protect security, enforce agreements, or protect rights, property, or safety.
  • In a Business Transaction. Information may be disclosed to professional advisers, financing sources, or a successor in connection with a merger, financing, reorganization, sale, bankruptcy, or transfer of some or all of Meridian's business, subject to applicable confidentiality and legal requirements.

Meridian does not publicly post your Personal Information, coaching information, testimonials, images, or results without an appropriate separate permission. Meridian does not disclose genetic information or consumer health data to employers or health insurers for their employment or underwriting purposes.

Medical and Genetic Reports Stay in Their Original Portals

Meridian follows a no-download operational rule for medical laboratory reports, raw genetic files, and genetic reports made available through independent partner or affiliate portals. Meridian may view an authorized report inside the originating secure portal for requested nonclinical coaching or coordination, but Meridian will not download, store, upload, or retransmit that report through the coaching environment, ordinary email, text message, or Meridian's general website systems.

You are responsible for using your individual portal credentials to access and download your own reports. If you cannot access a report, Meridian will direct you to or contact the applicable platform's support team instead of independently sending the report. Protect your login credentials and do not send protected reports to Meridian through an unapproved channel.

Cookies and Other Online Technologies

Cookies are small files or identifiers that websites and related technologies may place on a browser or device. Meridian may use essential cookies and similar technologies to operate forms and site features, remember preferences, protect security, prevent fraud, and maintain website performance. The website may also use analytics technologies if enabled to understand general traffic and improve the Services.

You can control many cookies through your browser settings and any preference tool presented on the website. Blocking essential technologies may prevent parts of the website from functioning correctly. Where required by applicable law, Meridian will request consent before using nonessential cookies or similar technologies.

Meridian does not intentionally send medical reports, genetic reports, raw DNA files, form contents containing sensitive health information, or activity inside independent secure portals to advertising or analytics providers. Meridian does not currently state that it engages in cross-context behavioral or targeted advertising. If that practice changes, this Policy and the website's choice mechanisms must be updated before the practice begins.

Your Choices

Marketing Communications

You may opt out of promotional email by using the unsubscribe instructions in the message or contacting support@meridianperformancehealth.com. You will continue to receive communications needed to administer an active membership, transaction, account, security matter, or legal notice.

Account and Coaching Information

You may update information through the applicable account or contact Meridian support. Information held in an independently controlled portal must be updated through that portal or its support process.

Cookies

You may adjust browser or website cookie preferences where available. Choices generally apply to the particular browser or device used and may need to be repeated after cookies are cleared.

Membership Cancellation

You may cancel a membership according to the Membership Agreement by contacting billing@meridianperformancehealth.com. Cancellation stops future membership renewal according to the applicable cancellation timing but does not automatically require deletion of transaction, consent, tax, dispute, or other records Meridian may lawfully retain.

Privacy Rights

Depending on where you live and the law that applies, you may have some or all of the following rights concerning Personal Information or consumer health data controlled by Meridian:

  • Access and Confirmation. Ask whether Meridian processes information about you and request access to eligible information.
  • Correction. Request correction of inaccurate information.
  • Deletion. Request deletion of eligible information, subject to permitted exceptions and retention requirements.
  • Withdrawal or Restriction. Withdraw consent or request that Meridian stop or restrict certain collection, use, or disclosure where applicable.
  • Information About Disclosures. Request information about categories of recipients or, where required, specific recipients of eligible consumer health data.
  • Portability. Request a portable copy of eligible information where required by law and technically feasible.
  • Appeal. Appeal Meridian's refusal to act on a request where applicable law provides that right.
  • Non-Discrimination. Exercise applicable privacy rights without unlawful discrimination.

Submit a privacy request to privacy@meridianperformancehealth.com. Meridian may request information reasonably necessary to verify your identity, account, state of residence, and authority to make the request. An authorized agent may submit a request where permitted by law, subject to verification. Meridian will respond within the time required by applicable law.

A request to Meridian reaches only information Meridian controls. For records maintained by an independent portal, laboratory, clinician, pharmacy, genetic-testing company, or other third party, you must also contact that organization using the information provided in its portal or privacy notice.

Additional Notice Concerning Consumer Health Data

Some state laws define consumer health data broadly to include information that identifies or permits an inference about physical or mental health, symptoms, diagnoses, medications, nutrition, fitness, reproductive or hormonal wellness, genetic information, laboratory information, or a person's use of health-related services or products, even when the information is not governed by HIPAA.

Meridian may collect the consumer health data described in "Personal Information We Collect" directly from you, from your interactions with the Services, and from authorized affiliate or partner portals. Meridian uses it only as reasonably necessary to provide the products or Services you request, personalize nonclinical coaching, communicate with you, provide support, maintain security, and comply with law. Categories of recipients are described in "How We Disclose Personal Information." Meridian will not collect, use, or disclose additional categories for materially different purposes without any notice and consent required by applicable law.

Where applicable, you may ask Meridian to confirm collection or disclosure, access or correct information, obtain recipient information, withdraw consent, stop future collection or disclosure, delete eligible data, or appeal a decision by emailing privacy@meridianperformancehealth.com. Meridian does not sell consumer health data and does not use geofencing around healthcare facilities to identify or target people seeking health services.

Security and Retention

Meridian uses reasonable administrative, technical, and physical safeguards appropriate to the nature and volume of information it controls. These measures include limiting account access, using vendor access controls, maintaining the no-download rule for medical and genetic reports, and keeping highly sensitive records out of the coaching environment, ordinary email, text messages, and general website forms. No transmission or storage system is guaranteed to be completely secure.

Meridian retains Personal Information only as reasonably necessary to provide Services, maintain transaction and consent records, resolve disputes, enforce agreements, and meet tax, accounting, security, insurance, and legal obligations. Retention periods vary by record type. Information controlled by an independent platform is retained under that organization's policies. Meridian's no-download rule limits the creation of additional copies of medical and genetic reports.

If you suspect unauthorized access to a Meridian-controlled account or information, contact support@meridianperformancehealth.com. Meridian will investigate suspected incidents and provide notices when required by applicable law. An incident involving an independently controlled platform may also be subject to that organization's investigation and notification process.

Third-Party Links and Services

The Services may link to or integrate with websites, portals, applications, products, and services operated by independent organizations. A link, referral, integration, preferred relationship, affiliate relationship, or coordinated-service arrangement does not make Meridian responsible for that organization's privacy, security, content, clinical decisions, or business practices. Review the third party's terms, privacy notice, and any applicable notice of privacy practices before providing information.

Children

The Services are intended for adults age 18 or older. Meridian does not knowingly collect Personal Information from a child through its general website or enroll a minor in an adult membership. If you believe a child submitted information without appropriate authorization, contact privacy@meridianperformancehealth.com.

United States Processing

Meridian is based in Missouri and provides Services in the United States. Personal Information may be processed in the United States and in other locations used by applicable service providers, subject to their terms and applicable law.

Changes to This Policy

Meridian may update this Policy to reflect changes in law, technology, vendors, or business practices. The revised Policy will show a new effective date. Meridian will provide additional notice or request consent before a material change where required by applicable law.
